Estos terminos regulan el acceso y uso de ARA SMART / ARA-Training SMART. These terms govern access to and use of ARA SMART / ARA-Training SMART.

1. Aceptacion
Al acceder o usar ARA SMART aceptas estos Terminos, la Politica de Privacidad y la Politica de Seguridad. Si usas la plataforma por una organizacion, confirmas que tienes autoridad para aceptar estos terminos por ella.
2. Servicio
ARA SMART puede incluir gestion de atletas, planes, microciclos, macrociclos, tests, zonas, analisis de actividades, dashboards de rendimiento, integraciones, seguimiento mental/deportivo, notificaciones, herramientas administrativas y funciones futuras. Las funciones pueden cambiar por mantenimiento, seguridad, disponibilidad tecnica, decisiones de producto o requisitos de proveedores.
3. Uso deportivo y no sustitucion medica
- La plataforma ofrece informacion de apoyo para entrenamiento y rendimiento, no diagnostico medico.
- Alertas, metricas, recomendaciones, IA o analisis deben ser revisados por entrenadores o profesionales competentes.
- El atleta debe detener la actividad y buscar ayuda profesional ante dolor, lesion, mareo, sintomas inusuales o riesgo de salud.
- Entrenadores y organizaciones son responsables de adaptar planes a edad, historial, condicion fisica, clima, lesiones, nivel y contexto real.
4. Cuentas, roles y permisos
Cada usuario debe proteger sus credenciales y no compartir cuentas. Los roles determinan permisos: atleta, coach, asistente, super admin u otros. Las relaciones coach-atleta, asistentes y acceso a datos deben responder a autorizacion, consentimiento y finalidad deportiva legitima. Podemos suspender o limitar cuentas por seguridad, fraude, abuso, incumplimiento legal o uso indebido.
4.1 Atletas menores de edad
ARA SMART puede permitir el registro de atletas menores de edad para fines deportivos, academicos o de equipo. Quien registre, invite o administre a un menor declara que cuenta con autorizacion valida de padre, madre, tutor legal, club, escuela u organizacion competente, segun la ley aplicable. Los entrenadores, clubes y organizaciones son responsables de informar a padres/tutores, limitar accesos, proteger datos del menor y usar la plataforma solo para la finalidad autorizada.
5. Integraciones externas
WHOOP, Garmin, Intervals.icu, Strava y otros proveedores tienen sus propios terminos, politicas, marcas, limites tecnicos y procesos de aprobacion. ARA SMART no controla sus servicios ni garantiza disponibilidad continua.
- El usuario autoriza scopes o permisos antes de conectar una fuente externa.
- El usuario puede revocar acceso desde ARA SMART o desde el proveedor.
- Los datos importados pueden tener retrasos, errores, cambios de formato o diferencias frente al proveedor original.
- El usuario y la organizacion deben respetar politicas de marca, datos y API de cada proveedor.
6. Datos y contenido del usuario
El usuario conserva derechos sobre datos y contenido que aporta. Al usar la plataforma, otorga a ARA SMART una licencia limitada para procesar, almacenar, mostrar, analizar y transmitir datos con el fin de prestar el servicio, operar integraciones autorizadas, dar soporte y mantener seguridad.
7. Uso aceptable
No debes usar la plataforma para acceder a cuentas ajenas, acosar, discriminar, vulnerar privacidad, exportar datos sin autorizacion, infringir derechos, eludir controles, subir malware, interferir con APIs, realizar scraping no autorizado o incumplir leyes.
8. Propiedad intelectual
ARA SMART, software, interfaces, diseno, documentacion, modelos, estructura y marcas pertenecen a sus titulares. Estos terminos conceden un derecho limitado, revocable, no transferible y no exclusivo para usar la plataforma segun estos terminos.
9. Pagos y disponibilidad
Planes de pago, modulos premium, licencias o acuerdos comerciales se regiran por condiciones indicadas al contratar o por acuerdos separados. Algunas funciones dependen de dispositivos, proveedores, suscripciones externas o permisos aprobados.
10. Responsabilidad y garantias
En la maxima medida permitida por la ley, ARA SMART no sera responsable por lesiones, decisiones de entrenamiento, interpretaciones de datos, interrupciones de proveedores, fallos de APIs externas, perdida indirecta, expectativas de rendimiento o uso contrario a estos terminos. La plataforma se ofrece segun disponibilidad razonable y no se garantiza que sea ininterrumpida, libre de errores o adecuada para todos los objetivos.
11. Privacidad y seguridad
El tratamiento de datos se explica en /privacy. Las medidas de seguridad se resumen en /security. Debes notificar accesos sospechosos y mantener tus integraciones bajo control.
12. Terminacion
Puedes dejar de usar la plataforma y solicitar cierre o eliminacion segun la Politica de Privacidad. Podemos suspender o terminar acceso por incumplimiento, seguridad, mantenimiento, requerimiento legal o cierre del servicio.
13. Ley aplicable y disputas
Estos terminos se interpretaran segun leyes aplicables al operador, usuario y servicio, respetando derechos obligatorios de consumidores y proteccion de datos. Las partes intentaran resolver disputas de buena fe antes de iniciar procedimientos formales.
14. Cambios y contacto

1. Acceptance
By accessing or using ARA SMART, you accept these Terms, the Privacy Policy, and the Security Policy. If you use the platform on behalf of an organization, you confirm that you have authority to accept these terms for that organization.
2. Service
ARA SMART may include athlete management, plans, microcycles, macrocycles, tests, zones, activity analysis, performance dashboards, integrations, mental/sports tracking, notifications, administrative tools, and future features. Features may change due to maintenance, security, technical availability, product decisions, or provider requirements.
3. Sports use and no medical substitute
- The platform provides training and performance support information, not medical diagnosis.
- Alerts, metrics, recommendations, AI, or analysis should be reviewed by competent coaches or professionals.
- Athletes should stop activity and seek professional help for pain, injury, dizziness, unusual symptoms, or health risk.
- Coaches and organizations are responsible for adapting plans to age, history, fitness, weather, injuries, level, and real-world context.
4. Accounts, roles, and permissions
Each user must protect credentials and not share accounts. Roles determine permissions: athlete, coach, assistant, super admin, or others. Coach-athlete relationships, assistants, and data access must be based on authorization, consent, and legitimate sports purpose. We may suspend or limit accounts for security, fraud, abuse, legal non-compliance, or misuse.
4.1 Minor athletes
ARA SMART may allow minor athletes to be registered for sports, academic, or team purposes. Anyone registering, inviting, or managing a minor represents that they have valid authorization from a parent, legal guardian, club, school, or competent organization under applicable law. Coaches, clubs, and organizations are responsible for informing parents/guardians, limiting access, protecting the minor's data, and using the platform only for the authorized purpose.
5. External integrations
WHOOP, Garmin, Intervals.icu, Strava, and other providers have their own terms, policies, marks, technical limits, and approval processes. ARA SMART does not control their services or guarantee continuous availability.
- The user authorizes scopes or permissions before connecting an external source.
- The user may revoke access through ARA SMART or the provider.
- Imported data may include delays, errors, format changes, or differences from the original provider.
- The user and organization must respect each provider's brand, data, and API policies.
6. User data and content
The user retains rights in data and content they provide. By using the platform, the user grants ARA SMART a limited license to process, store, display, analyze, and transmit data to provide the service, operate authorized integrations, provide support, and maintain security.
7. Acceptable use
You must not use the platform to access other accounts, harass, discriminate, violate privacy, export data without authorization, infringe rights, bypass controls, upload malware, interfere with APIs, perform unauthorized scraping, or violate laws.
8. Intellectual property
ARA SMART, software, interfaces, design, documentation, models, structure, and marks belong to their owners. These terms grant only a limited, revocable, non-transferable, non-exclusive right to use the platform under these terms.
9. Payments and availability
Paid plans, premium modules, licenses, or commercial agreements are governed by terms shown at purchase or by separate agreements. Some features depend on devices, providers, external subscriptions, or approved permissions.
10. Liability and warranties
To the maximum extent permitted by law, ARA SMART is not liable for injuries, training decisions, data interpretations, provider interruptions, external API failures, indirect losses, performance expectations, or use contrary to these terms. The platform is provided subject to reasonable availability and is not guaranteed to be uninterrupted, error-free, or suitable for every goal.
11. Privacy and security
Data processing is explained at /privacy. Security measures are summarized at /security. You must report suspicious access and keep integrations under control.
12. Termination
You may stop using the platform and request closure or deletion under the Privacy Policy. We may suspend or terminate access for non-compliance, security, maintenance, legal requirements, or service closure.
13. Governing law and disputes
These terms will be interpreted under laws applicable to the operator, user, and service, while respecting mandatory consumer and data protection rights. The parties will attempt to resolve disputes in good faith before formal proceedings.
14. Changes and contact
